Husch Blackwell Title IX report published

Expert compliance firm's comprehensive review "unable to identify any broad systemic compliance failures"

In response to concerns expressed on ShareYourStory during the summer of 2020, Binghamton University retained Husch Blackwell LLP, a nationally recognized law firm with specialization in Title IX Higher Education compliance, to conduct a comprehensive review of the University’s compliance with Title IX of the Education Amendments of 1972.

Specifically, the University requested that Husch Blackwell conduct an independent analysis of the University’s response to sex-based misconduct, including all policies, practices and administrative offices involved in providing services. The report is now available and contains a summary of Husch Blackwell’s review, analysis of issues and recommendations for improving processes.

Husch Blackwell’s investigation determined that the University handles Title IX related matters in a manner consistent with law, policy and recognized best practices, while also recommending steps for improvement ranging from hiring additional investigators and expanding informal resolution options to improving the Title IX website and enhancing communication to all students.

A central point of the report states, “We have certainly been unable to identify any broad systemic compliance failures. The University’s personnel are well-trained practitioners in their respective fields and the University’s infrastructure for responding to Title IX-related matters is robust.”

The report also clearly states: “Complaints regarding University ‘negligence’ or ‘unprofessionalism’ are unsubstantiated.” … “We are confident that the employees tasked with navigating these issues are committed to respecting all students’ rights and ensuring that individuals impacted by sexual misconduct and interpersonal violence receive appropriate support and resources throughout the process.”

While the report acknowledges the strengths of the University’s Title IX program and processes, it also makes clear there is work to be done to better inform the campus community and to make certain those impacted by sexual misconduct feel supported.

In the coming weeks, the University will review Husch Blackwell’s recommendations and implement them appropriately by the fall semester. Some initiatives are already underway and others will be complete this semester. For example, a deputy Title IX coordinator has been hired to assist with investigations and the Violence, Abuse and Rape Crisis Center (VARCC) is set to open shortly.

The University is grateful for the work that Husch Blackwell put into this report and for the feedback of all the students and staff who met with them.
